ARTICLE 31
Complete Agreement And Severability
Section 1. Effect. This Agreement
constitutes the full and complete written Agreement between the Employer and
UTCE. The parties specifically agree that the provisions of this collective bargaining
Agreement supersede any and all prior agreements as indicated in this Agreement.
The parties specifically agree that portions of prior collective bargaining
agreement will continue in effect only if contained in attached appendices which
are incorporated by reference as if fully set forth herein.
Section 2. Finality. The provisions of this collective
bargaining Agreement will not be open for negotiations during the term of the
agreement except as described in this Agreement or through mutual consent of
the parties in a written, signed Memorandum of Understanding incorporated by
reference into this Agreement.
Section 3. Severability. The provisions of this Agreement
shall be severable and if any provisions thereof or the application of any such
provision under any circumstances is held invalid, it shall not affect any other
provision of this Agreement or the application of any provision thereof. If a
provision is rendered inoperative by this Article, but subsequently becomes legal
as a result of a modification of federal and state laws during the term of this
Agreement or extension thereof, the operation of such provision shall be renewed.
