Unique Provisions, Personnel Plan for MnSCU for Administrators

The Personnel Plan for Administrators does not contain ‘layoff’ provisions. It is not practicable or appropriate to apply the basic concepts of layoff (separation in reverse seniority order and the right to be recalled to future vacancies) to ‘at-will’ employees with a wide variety of duties requiring different skill sets. The following questions and answers apply to Administrators in continuing appointments, as defined in the Plan, and do not apply to interim, acting or temporary Administrators or those Administrators with individual employment contracts.
1. How much notice do we need to give an Administrator if their appointment is being ended due to budgetary restrictions? Administrator must be notified, in writing, at least 3 months prior to the end of their appointment. (See Section 1.03, Subd. 3 ( C ))
2. Are Administrators whose appointments are terminated for budget reasons automatically eligible for severance pay? No, the Personnel Plan does not provide severance pay for Administrators unless they meet one of the age and/or service requirements listed in the Plan. Separation for budgetary reasons is not listed. (See Section 1.08, Subd. 1)
3. Are Administrators eligible for continued employer contributions for insurance if they are involuntarily separated for budget reasons? Those Administrators who have been continuously employed in the System for at least 3 years remain eligible for the employer contribution of 6 months following their separation date or until they reach age 65, whichever comes first. (See Section 1.09, Subd. 4 (D ))
4. How do we code the separation of Administrators for budget reasons? Even though these actions are not layoffs, you should use the code for Layoff so that we can track the number of affected Administrators for reporting purposes and to help us identify those individuals eligible for continued employer contributions for insurance. We are considering the creation of a new separation code for Reductions In Force for unclassified non-faculty employees. See the instructions linked here / chart.
